Effective June 15, 2001 the Board of Directors for the Arabian Acres Property Owners Association has enacted the following addition to the ARCHITECTURAL Controls, known as a(Construction Clean-up Deposit)to ensure that new owners do not get left with clean up of construction materials, brush piles, tree stumps and rubbish from construction by contractors. It is recommended that buyer's, and or new owners ensure that any contract between themselves, and contractors include a clean-up clause that ensures the contractor is responsible for all clean-up of the construction site, including Trees, Tree Stumps, Brush, Tree limbs and all rubbish from construction. Additionally buyer's and or owners should inform the contractor of the Clean-up Deposit in place by the AAPOA



1.This addition to the Architectural Controls is designed to protect the property owner from contractors that refuse to clean up the construction area after construction is completed.

Architectural Control Requirements


ARABIAN ACRES PROPERTY OWNERS ASSOCIATION


Information Required For Consideration By The Association

Before any site preparation, clearing of trees, or commencement of any construction, you must first submit the following items to the ARABIAN ACRES PROPERTY OWNERS ASSOCIATION for their approval with regards to the provisions of the existing Arabian Acres Protective Covenants. These items will be returned to you, along with the Approval or Denial Certification issued by the Association regarding your proposed construction. This certificate will be issued within thirty (30) days.


(1) A completed construction permit application, signed, dated, and accompanied by the REQUESTED and required county permits and or documents.

(2) The CONTRACTOR, or CONTRACTORS that will be performing the actual clearing of the building site must post a deposit, in the form of a BANK CERTIFIED CHECK, for $1000.00 with the AAPOA Treasurer.
PERSONAL OR BUSINESS CHECKS WILL NOT BE ACCEPTED.


(3) This bond will be returned in full providing that all cleanup of the site is accomplished in accordance with County Ordinances, the Certification of the Property Owner, and the AAPOA.
Failure to accomplish the required clean up of the site will result in forfeiture of the Entire deposit which will then be used for the benefit of the property owner in cleaning up the construction site.
